Hashtag Rights Request Terms and Conditions

Hello from Wichita, Kansas, the Heart of the Country! If you’re visiting this page, it’s likely because the photo or video you shared on social media caught our eye and we’ve asked for the rights to share it. So what does it mean if you give us the rights to use your content by replying with #YesVisitWichita? Read the following FAQs along with official Visit Wichita Terms and Conditions. 

Why is Visit Wichita asking for the rights to my video or photo?

Because we love your content and want to potentially utilize it in our marketing efforts to encourage the world to come visit Wichita, the Heart of the Country!

Where and how will Visit Wichita use my video or photo?

We may want to use it for a variety of purposes. We might want to share it to our Instagram feed. We may also wish to include it on our user generated content galleries throughout our website. Other places we may use the photo and/or video content include but are not limited to our social media channels (Facebook, Instagram, X, LinkedIn) – in both organic and paid posts, VisitWichita.com, our official Wichita Visitors Guide, Meeting Planners Guide, and digital ad placement.

Will you let people know it’s my photo or video?

We will give you credit by displaying your username, name or image where and when we can, but we cannot guarantee it as a limited number of placements may not allow for it. Typically, we will make every effort to give you credit.

Will you edit my photo or video?

Some placements may require images and videos be cropped to better fit within the dimension requirements. However, we will try not to make too many edits since we already love your video/photo!

Will you pay for my photo or video? 

Compensation for user-generated content is not within the policy of Visit Wichita. 

Participant Agreement

By replying to the request of Visit Wichita to participate in CrowdRiff (content aggregation tool) with the hashtag #YesVisitWichita, you agree to all the terms and conditions in this agreement. Visit Wichita, which does business using the domain name VisitWichita.com, also agrees to abide by these Terms and Conditions. Visit Wichita may terminate its websites or its use of your content at any time at its sole discretion. Any attempt by the participant to change any of the Terms and Conditions is hereby rejected and shall not be made part of the Terms and Conditions unless expressly agreed to in writing by an authorized representative of Visit Wichita.

Allowable Participants

Participants must be 18 years of age or older and have the legal right to enter into this agreement and to grant any and all rights to their name, username and image (collectively “name”) and user-generated content in the form of original photography, video or text.

Non-Confidentiality

Participants understand and agree that their name and content will be publicly displayed and that it will not be treated in confidence. By replying to Visit Wichita’s request to participate, the participant provides Visit Wichita with the unlimited, worldwide right to use and share your name and content on VisitWichita.com, in all social media channels such as Facebook, Instagram, X, and other social media platforms that may be developed in the future including both organic posts and paid ads; its printed marketing materials such as the Official Wichita Visitors Guide, Meeting Planners Guide and other printed collaterals; digital ads; and other promotional materials of any kind or type.

Visit Wichita Rights to User Generated Content

By replying to Visit Wichita’s request to participate in CrowdRiff (content aggregation tool) with the hashtag #YesVisitWichita, you are agreeing to these Terms and Conditions. You grant Visit Wichita and its agents a perpetual, transferable, sublicensable, non-exclusive worldwide license to (a) use, copy, transmit, distribute, reproduce, modify, create derivative works from, adapt, combine with other ideas or works, publish, translate, publicly perform, publicly broadcast and publicly display your name and content (or any modification thereto) in whole or in part, in any format or medium now known or later developed, and (b) use (and permit others to use) your name and content in any manner and for any purpose, including without limitation: marketing, advertising, commercial or promotional purposes that Visit Wichita or its agents deem appropriate. To be clear, Visit Wichita will have the right, but not the obligation, to use the name and content, as authorized in this agreement.

The participant agrees that they have the sole responsibility for their content. Visit Wichita is not required to host, display, or distribute any content on or through its websites, on social media or otherwise, and may remove content at any time or refuse content for any reason. Visit Wichita is not responsible for any loss, theft, misuse or damage of any kind to a participant’s content.

By replying to Visit Wichita’s request to participate in CrowdRiff (content aggregation tool) with the hashtag #YesVisitWichita, participants warrant that:

• They are at least 18 years of age and they have the legal right to entre into this agreement and they are not impersonating anyone else.
• They own all the rights in and to their name and content including without limitation, all rights to the audio, video and or digital recording and performance contained in their content (if any), and/or they have acquired all necessary rights to the elements appearing in their content to enable them to grant all the rights to Visit Wichita as described herein.
• Their content is wholly original and does not infringe on the copyright, trademark, patent, trade secret or any other intellectual property rights, privacy rights, or any other legal or moral rights of any third-party individual or entity.
• They agree to release and allow all creative license and creative treatment in the use and production of your content at the discretion of Visit Wichita and its agents.
• They voluntarily agree to waive all “moral rights” that they may have to their content.
• All information contained in the participant’s content is not known to or reasonably believed by them to be false, inaccurate or misleading.
• Their content does not violate any law
• They were not and will not be compensated or granted any consideration by any third party for submitting their content.
• They will not be compensated or granted any consideration in any way by Visit Wichita for the use of their name or content.
• Their content does not incorporate materials from a third-party website, copyright-protected materials or personally identifiable information of anyone other than themselves.
• Their content does not reflect negatively in any way upon the city of Wichita or the marketing, advertising, commercial or promotional efforts of the city of Wichita or Visit Wichita.
• They irrevocably release and forever discharge Visit Wichita and its agents, directors, officers, affiliated entities, employees, contractors and third party providers (“released parties”) from any and all actions, claims, damages, liabilities and demands, whether absolute or contingent and of any nature whatsoever, which they now have or hereafter may have against any of the released parties, or their respective successors or assigns, arising out of or related in any way to use of their name, content or anything contained therein.

Indemnification

The participant agrees to indemnify, defend and hold harmless Visit Wichita and its agents, directors, officers, affiliated entities, employees, contractors and third-party providers (indemnified parties) from and against any and all claims, liabilities, damages, losses, cost, expenses or fees (including reasonable attorney’s fees) that any of the indemnified parties may incur arising out of or related to the name, content or the participant’s breach of this agreement.

Visit Wichita reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by the participant and they agree to cooperate with Visit Wichita’s defense of such claims as their own expense.

Modification to These Terms and Conditions

Visit Wichita may, at its sole discretion, change these Terms and Conditions at any time. Any changes will be posted online and will be effective upon posting unless an effective date is specified.

Removal

Should the participant want their content removed from Visit Wichita’s website, they will need to send a message to the following: info@visitwichita.com. After Visit Wichita acknowledges receipt of the participant’s email, Visit Wichita will have 30 days to take action, though Visit Wichita reserves the right to refuse such a request.

Linking, Crawling and Archiving

If the participant would like to link to the websites of Visit Wichita, they much comply with the following guidelines:

• The participant must not incorporate any content from this site onto their site or social media channels by in-lining, framing or creating other browser or border environments around the website content. The participant must also link to and not replicate the content on the websites of Visit Wichita.
• The participant must not use any Visit Wichita intellectual property, including Visit Wichita’s trademarks, logos, designs or service marks on their site.
• The participant may not create the appearance or impression of a relationship or affiliation between them or any third party at Visit Wichita.
• The participant’s site or social media channels may not, in sole discretion of Visit Wichita, contain offensive, distasteful, illegal or inappropriate content.
• If the participant would like to use a web crawler or other research tool to gather information from Visit Wichita’s website, they must comply with the provision of the robots.txt file of the site and they may not circumvent CAPTCHA or other security measures.

Other Conditions and Restrictions

ATTENTION: Any attempt by any individual to deliberately damage the Visit Wichita website, tamper with the aggregation process, or otherwise undermine the legitimate operation of the CrowdRiff program may be a violation of criminal and civil laws. Should such an attempt be made, Visit Wichita reserves the right to cooperate in the prosecution of any such individual(s) and to pursue all remedies to the fullest extent permitted by law.

These Terms and Conditions and the Privacy Statement together with any additional terms to which a participant agrees when using particular elements of the website(s) constitute the entire and exclusive agreement between them and Visit Wichita.
